When you purchase a used car through a used-car loan, the loan does not just stay between you and the financier as EMIs and repayment terms. Since the vehicle acts as collateral for the loan, the financier's name becomes part of the RC until you repay the loan. Form 34 is used to add the financier's name to the RC.

This blog takes you through what RTO Form 34 means, when you need it for a used car, and how to add bank hypothecation using Form 34.

What Is RTO Form 34?

Form 34 is an RTO form under the Central Motor Vehicles Rules, 1989, used to record the financier's details in the RC when you purchase a car through a vehicle loan. Once the RTO processes the form, the details are recorded in the relevant registration records and the RC. Both the buyer and the bank or financial institution need to sign Form 34 before it is submitted to the RTO.

What Does Hypothecation Mean for a Car Loan?

When you take a loan to buy a car, the lender finances the purchase against the car as security. The car remains with you and you can use it, but the lender's details are recorded in the RC until the loan is repaid.

If you fail to repay the loan as agreed, the lender may have the right to take possession of and sell the vehicle to recover the outstanding dues, subject to the loan agreement and applicable rules.

Does RTO Form 34 Apply to Used Cars or Only New Cars?

Form 34 is not related to whether the car is new or used. It depends on how you purchase the car. If you purchase the car using a loan, the lender's details need to be added to the RC through hypothecation, and Form 34 is used for this purpose. However, if you purchase the car without a loan, there is no lender to add to the RC, so Form 34 does not apply.

The scenarios below show when Form 34 applies and when it may not:

  • New car purchased with a car loan: Form 34 applies.
  • Used car purchased with a used-car loan: Form 34 applies.
  • New car purchased without a loan: Form 34 may not apply.
  • Used car purchased without a loan: Form 34 may not apply.

How to Download RTO Form 34 Online?

You can download Form 34 from the official Parivahan Sewa website.

  • Go to the Parivahan Sewa website.
  • Select Downloadable Forms.
  • Find Form 34: Application for Making an Entry of an Agreement of Hire-Purchase/Lease/Hypothecation Subsequent to Registration.
  • Click on Form 34 to open and download the PDF.

You can then print the form, fill in the required details and get the required signatures before submitting it to the RTO.

How to Fill RTO Form 34?

Form 34 has two sections. One section is filled in by the buyer with the financier's details and signatures, while the other section is completed by the RTO.

The Details to Be Entered in Form 34 Include:

  • The RTO where the vehicle is registered
  • The vehicle's registration number
  • Details of the registered owner or the person to be registered as the owner
  • Full name and address of the bank or financial institution
  • The agreement or loan account number
  • The mobile number requested in the form

The form then needs to be signed by the owner and the financier. By signing the form, both parties request the RTO to record the hire-purchase, lease or hypothecation agreement in the vehicle's registration records. The applicable fee also needs to be paid along with the required documents.

The "Office Endorsement" section of Form 34 is completed by the RTO. Once the application is approved, the RTO records the hypothecation in its registration records, Form 24 and the RC. The copies with the RTO's approval are then sent to the financier and the concerned registering authority, where applicable.

What Documents are Required to Add Hypothecation to the RC?

You may need the following documents to add hypothecation to a vehicle's RC:

  • Form 34, signed by the vehicle owner and financier
  • Original Registration Certificate (RC)
  • Proof of address
  • Valid insurance certificate
  • Pollution Under Control (PUC) certificate
  • PAN card or Form 97 (earlier Form 60), as applicable
  • Chassis and engine number pencil print
  • Signature identification of the owner
  • Acknowledgement of Form 29 and Form 30 submission, if the ownership transfer is still in process

Note: Additional documents may be required depending on the state or RTO. Check the requirements applicable to your vehicle before submitting the application.

How to Add Hypothecation to a Car RC Online?

You can add the lender to a used car's RC either by visiting the RTO or through the VAHAN portal. Depending on the state, you may be able to complete the entire hypothecation process online, including submitting the request, uploading the required documents and paying the applicable fee. In some cases, you may still need to visit the RTO for document verification or submission.

1. Start the Ownership Transfer

The seller needs to initiate the ownership transfer using Form 29, after which the buyer continues the process using Form 30. The transfer can be started through VAHAN or handled through the RTO. Once the ownership transfer is in process, you can start the hypothecation addition with Form 34.

Note: In some cases, the ownership transfer may need to be completed before the hypothecation request can be processed.

2. Fill Form 34 and Keep the Documents Ready

Fill Form 34 with the required vehicle, buyer and financier details and get the required signatures. Keep the RC and other supporting documents required by your RTO ready.

3. Log in to VAHAN

Go to the VAHAN/Parivahan portal and click Online Services → Vehicle Related Services. You can also scroll down the home page to find the Vehicle Related Services option. The portal will then ask you to select the state. Once you select the state, the state-specific VAHAN page will open.

Log in by entering the vehicle registration number and selecting the concerned RTO. Complete the required verification to access the vehicle-related services.

4. Select "Hypothecation Endorsement" and Enter the Details

Select Hypothecation Endorsement from the available services. You will then be asked to select the relevant option from hire-purchase, lease or hypothecation. For a used car purchased through a loan, select hypothecation.

Enter the required vehicle, buyer and financier details, along with the relevant loan or financing agreement details. Upload Form 34 and the other documents requested on the portal.

5. Review, Pay and Submit

Check all the details before submitting the application. Make any required corrections, pay the applicable fee and submit the application.

6. Note the Application Number and Check the RC

After submission, keep the application or acknowledgement number for tracking. Once the application is approved, the hypothecation is recorded in the registration records and RC, with the lender's details linked to the vehicle.

How to Check the Hypothecation Addition Status?

Once you submit the hypothecation addition application, you can check its status through the VAHAN portal.

Go to VAHAN → Online Services → Vehicle Related Services → Know Your Application Status. Enter your application number, vehicle registration number and captcha to check the current status of your application.

What Is the Timeline and Fee for Hypothecation Addition to a Car RC?

The fee for adding hypothecation to a car RC is based on the applicable fee under Rule 81 of the Central Motor Vehicles Rules, 1989. The amount can vary based on the vehicle and the applicable state or RTO. The exact fee is shown during the VAHAN application process before you make the payment.

The processing time can vary depending on the RTO, the completeness and accuracy of the application and documents submitted, and the verification process. After submitting the application, you can use the application number to check its status on VAHAN.

Is Insurance Required to Add Hypothecation to the RC?

Insurance is required not just for adding hypothecation, but for using a vehicle on public roads in India under the Motor Vehicles Act, 1988. The type of insurance is where the difference comes in. Third-party insurance is mandatory, while comprehensive insurance is optional from a legal requirement perspective.

Third-party insurance covers the loss or damage caused to another person or their vehicle in an accident. It does not cover damage to your own car. Comprehensive insurance also covers damage to your own car, along with third-party cover.

What Happens to Hypothecation After You Repay the Loan?

Once you repay the used-car loan in full, you need to get the required loan-closure documents from the lender, such as the No Objection Certificate (NOC) or due-clearance certificate and Form 35. Form 35 needs to be signed by the registered owner and the financier.

You can then apply for hypothecation termination through the VAHAN portal. Once approved, the hypothecation entry is removed from the RC and the vehicle's registration records.

You may need the lender’s involvement before transferring or selling a vehicle that has an active hypothecation. The outstanding loan generally needs to be dealt with before the lender’s interest can be removed from the RC.

Form 34 is not a mandatory document for every vehicle. It is required when a hire-purchase, lease or hypothecation agreement needs to be recorded in the vehicle's registration records.
