Sections 80EE and 80EEA of the Income-tax Act, 1961, allowed eligible first-time homebuyers to claim additional deductions on home loan interest of up to ₹50,000 and ₹1.5 lakh, respectively, subject to specific conditions.

Both schemes are no longer available for new home loans. Loans sanctioned after the respective scheme deadlines do not qualify for these deductions, even if the borrowers meet the property and eligibility conditions. However, eligible borrowers with loans sanctioned during the respective periods may continue to claim the deductions, subject to the applicable conditions.

From 1 April 2026, the Income-tax Act, 2025, came into effect. Sections 80EE and 80EEA of the Income-tax Act, 1961, correspond to Sections 130 and 131, respectively, under the new Act. Eligible borrowers must refer to the applicable provisions when claiming these deductions.

This blog explains the differences between Sections 80EE and 80EEA, their eligibility criteria, the deductions available, and the conditions borrowers must meet to claim these tax benefits.

What Is Section 130 (Earlier Section 80EE)?

Section 130 of the Income-tax Act, 2025, allows eligible individuals to claim an additional tax deduction of up to ₹50,000 on home loan interest, subject to specific conditions.

Eligibility Criteria for Section 130

  1. First-time Homebuyer: You (taxpayer) should not own any other residential property at the time of loan sanction.
  2. Loan Sanction Period: The home loan should have been sanctioned between April 1, 2016, and March 31, 2017.
  3. Loan Amount Cap: The loan amount should not exceed ₹35 lakh.
  4. Property Value Limit: The total value of the house should not exceed ₹50 lakh.
  5. Loan Provider: The home loan must be availed from a financial institution or a housing finance company.
  6. Taxpayer Type: Only individuals can claim this benefit (not HUFs, companies, or firms).

What Is Section 131 (Earlier Section 80EEA)

Section 131 of the Income-tax Act, 2025, allows eligible individuals to claim an additional tax deduction of up to ₹1.5 lakh on home loan interest, subject to specific conditions.

Eligibility Criteria for Section 131

  1. First-time Homebuyer: You (taxpayer) must not own any other house at the time of loan sanction
  2. Loan Sanction Period: The loan must be sanctioned between April 1, 2019, and March 31, 2022.
  3. Stamp Duty Value Limit: The property’s stamp duty value should not exceed ₹45 lakh.
  4. Loan Provider: The loan must be taken from a bank or housing finance company.
  5. Taxpayer Type: Only individuals can claim this deduction.
  6. Cannot Claim Section 131 Alongside Section 130: If you qualify for a deduction under Section 130, you cannot claim the deduction under Section 131.

Section 130 vs. Section 131

If you opt for the new tax regime, you cannot claim deductions under Section 130 or Section 131. Under the old tax regime, eligible borrowers may continue to claim these deductions, subject to the applicable conditions.

How to Claim Tax Deductions Under Sections 130 and 131

  • Check Eligibility – Ensure you meet the applicable conditions for Section 130 or Section 131, including the loan sanction period.
  • Get Your Loan Interest Certificate – Obtain a home loan interest certificate from your lender.
  • Choose the Tax Regime: These deductions are available only under the old tax regime.
  • Declare in Your ITR: Report the eligible deduction in your Income Tax Return (ITR).
  • Submit Proofs to Your Employer: If you are salaried, submit the relevant loan documents to your employer for TDS calculations.
  • Self-Employed? Keep your loan interest certificate and supporting documents handy when filing your ITR.

Final Thoughts

If you took a home loan between April 1, 2016 - March 31, 2017, and meet the eligibility criteria, you qualify for Section 80EE. However, if your loan was sanctioned between April 1, 2019 - March 31, 2022, and your property’s stamp duty value is ₹45 lakh or less, you can claim Section 80EEA.

Both deductions help first-time homebuyers reduce tax liability, but they cannot be claimed together. Make sure to choose the one applicable to you for maximum savings.
