Depending on your state and lender, the hypothecation may now be removed automatically after your vehicle loan is closed. If not, you can apply online or visit the RTO to complete the process.

What is Hypothecation in a Car RC?

When you buy a car using a vehicle loan, whether it is a new car loan or a used car loan, the vehicle acts as collateral for the loan. The RC mentions you as the owner and also lists the lender's name under the hypothecation section, usually as "Hypothecated to <Lender Name>". This arrangement is known as hypothecation.

If you fail to repay the loan, the lender has the legal right to take possession of the vehicle, as per the loan agreement and applicable laws, to recover the outstanding amount.

What is Vehicle Hypothecation Termination?

Removing hypothecation from the RC means updating the vehicle records after you have fully repaid your vehicle loan. Once the hypothecation is removed, the lender's name is deleted from the RC, confirming that the lender no longer has any claim over the vehicle. An updated RC is then issued without the hypothecation entry, showing you as the sole owner of the vehicle with no active lender's charge.

Is Hypothecation Removed Automatically After Loan Closure?

Whether hypothecation is removed automatically or you need to apply for its removal depends on your state and lender. From 1 March 2026, the Ministry of Road Transport and Highways (MoRTH) introduced a new digital system under which banks and NBFCs can report loan closures directly to the VAHAN and Parivahan system.

 

The lender digitally submits the loan closure details and the No Objection Certificate (NOC) through the VAHAN and Parivahan system. Once the details are verified, the hypothecation is removed, and an updated RC is issued without the "Hypothecated to <Lender Name>" entry.

 

However, automatic removal of hypothecation from RC has not yet been implemented across all states or by every lender. The rollout is happening in phases, with more transport departments, banks, and NBFCs being added over time.

 

Check whether your state and lender support automatic hypothecation removal. If they don't, you will need to apply for hypothecation removal online, where available, using Form 35, or submit the required documents at the concerned RTO.

What is Form 35 After Car Loan Closure?

Form 35 is the official document issued by the bank or NBFC after you have fully repaid your vehicle loan. It confirms that the loan has been closed and that the lender has no objection to removing the hypothecation from your vehicle’s RC.

 

The form is signed by the lender and the vehicle owner and is submitted to the RTO along with other required documents to request the removal of the hypothecation entry from the RC.

How to Apply for Hypothecation Removal from Your Car RC Online Using Form 35

If online hypothecation removal is available in your state, follow these steps to update your RC after closing your vehicle loan.

Step 1: Repay your vehicle loan

Repay the entire loan amount. Also clear any pending dues, such as missed EMI charges, foreclosure charges, or other applicable fees, so that the lender can close your loan account.

Step 2: Collect the required documents from the lender

After the loan is closed, collect the Loan Closure Certificate, NOC, Form 35, and any other documents required for hypothecation removal.

Step 3: Apply through the VAHAN portal 

Visit the VAHAN portal and log in using your vehicle registration details. Under “Online Services” or the relevant vehicle services section, select “Hypothecation Termination”. Fill in the required details, upload the documents (where required), and pay the applicable fee. 

Step 4: Visit the RTO, if required

In some states, you may also need to visit the concerned RTO with the printed application, payment receipt, Form 35, and other supporting documents for document verification and final approval.

Step 5: Receive the updated RC

Once the RTO verifies your application, the hypothecation is removed from the vehicle records. An updated RC is then issued showing you as the registered owner, with no hypothecation entry.

What Documents are Required to Remove Hypothecation from a Car RC?

The exact documents to terminate hypothecation from RC may vary slightly depending on your state's transport department.

 

However, you will generally need the following:

  • Form 35
  • Loan Closure Certificate
  • No Objection Certificate (NOC)
  • Original Registration Certificate (RC), if required
  • Valid Motor Insurance Certificate
  • Valid Pollution Under Control (PUC) Certificate, where applicable
  • Identity proof of the vehicle owner
  • Applicable fee receipt

How to Check the Hypothecation Removal Status of Car RC

After applying for hypothecation removal, you can verify whether the lender's name has been removed from your RC through any of the following:

  • VAHAN/Parivahan Portal: Check your vehicle details using the registration number
  • mParivahan App: View the latest RC details on your mobile device
  • DigiLocker: If your RC is linked, the updated version will reflect the removal of the hypothecation entry
  • Physical RC: If a new RC has been issued, check whether the "Hypothecated to <Lender Name>" entry has been removed

If the lender's name no longer appears on your RC, the hypothecation has been successfully removed.

What Happens if You Don't Remove Hypothecation After Closing the Loan?

Repaying your vehicle loan does not automatically mean the hypothecation entry disappears from your RC (where automatic hypothecation removal is not available).

 

If you don't remove it, you may face issues later, such as:

  • Selling the vehicle may become difficult, as most buyers prefer an RC without a hypothecation entry
  • Vehicle ownership transfer may get delayed until the hypothecation is removed from the RC
  • RTO services may take longer, as some services require the hypothecation to be removed before they can be processed
  • You may need to obtain duplicate documents from the lender if you delay the process and lose the original Form 35 or loan closure documents
  • Your vehicle records will continue to show the lender's name, even though the loan has already been repaid

Final Thoughts

Paying the last EMI closes your vehicle loan, but the hypothecation may still remain linked to your RC.
