Moving your car to another state for your own use or selling it to a buyer in another state comes with legal and compliance requirements. Road tax may change, the maximum permitted age of the vehicle may differ, and registering the vehicle with the RTO of the state where you will be residing may also be required. Form 28 is an important document when registering the vehicle with the new RTO.

This blog will take you through Form 28, when it is required, who needs to apply for it, the documents required, and what you need to do after receiving the NOC.

What is RTO Form 28 for Transferring a Vehicle to Another State?

Form 28 is the form used to apply for a No-Objection Certificate (NOC) from the RTO where the vehicle is currently registered. The NOC confirms that there are no pending challans, tax dues, other dues or objections with the current RTO that prevent the vehicle from being moved or transferred to another state.

The current owner or seller of the car generally applies for the NOC. Form 28 is just an application for issuing an NOC and not an application for transferring ownership. Depending on the reason for the transfer, other forms may be required, such as Form 27, Form 29, and Form 30, for transferring ownership or registering the vehicle with the new RTO.

When Do You Need RTO Form 28?

RTO Form 28 may be needed or applied in several situations, depending on the reason for moving, selling or transferring the vehicle.

1. Selling a Vehicle to a Buyer in Another State

When you intend to sell your vehicle to a buyer in another state, getting the NOC from the current RTO helps meet the required RTO formalities and avoid delays in transferring the vehicle.

2. Buying a Vehicle From Another State

If you are buying a vehicle from another state, make sure the seller has obtained an NOC from the RTO where the vehicle is currently registered. Having the NOC can help you avoid issues when applying for a used car loan and registering the vehicle with the new RTO. In most cases, as the buyer, you do not have to apply for the NOC yourself.

3. Moving a Vehicle to Another RTO Jurisdiction Within the Same State

Some RTO jurisdictions may require an NOC from the previous RTO even when the vehicle is being sold or transferred within the same state. You may also choose to register the vehicle with a different RTO jurisdiction within the state. In such cases, Form 28 may be required to obtain the NOC from the current RTO.

4. Removing Hypothecation After Loan Repayment

After the vehicle loan is fully repaid, you need to remove the hypothecation from the RC. Apart from the financier's NOC, the RTO where the vehicle is currently registered may also require an NOC from the previous RTO if the vehicle was transferred from another jurisdiction.

5. Moving a Vehicle to Another State for Your Own Use

When you move to another state and intend to keep and use the vehicle there for more than the applicable period, generally 12 months under the current rule, you need to apply for a new registration mark with the concerned RTO.

A Point to Look At: There have been recent proposals to increase the current 12-month period for keeping a vehicle in another state before re-registration to up to three years. However, the proposal is still under discussion and has not been implemented. The current 12-month rule continues to apply.

Where to Download RTO Form 28 For Inter-State Transfer?

You can download Form 28 from the Parivahan Sewa website. Go to "Information Services" and select "Download Forms". Find and click on "Form 28 – Application for No Objection Certificate and Grant of Certificate" from the list. The form will appear for you to download or print.

You can also check your state transport department or RTO portal if you want the form in the state language, as some states provide it. If you use a third-party website, make sure the form matches the latest official Form 28 format before downloading or using it.

How to Fill Form 28 RTO For Inter-State Transfer?

Form 28 has three parts. The first part is filled by the registered owner, the second is for the financier if the vehicle is purchased through a loan, or on lease and the third is completed by the RTO.

Part 1 – To Be Filled by the Owner

In the application section of the RTO Form 28, you need to:

  • Enter the current registering authority where the vehicle is registered.
  • Enter the buyer and destination RTO details, if the vehicle is being sold.
  • Enter the owner's personal details.
  • Enter the vehicle details, including registration, engine/motor and chassis numbers.
  • Mention the period for which the vehicle has stayed in the state.
  • Enter the period up to which motor vehicle tax has been paid.
  • Disclose any pending tax demands.
  • Disclose whether the vehicle is involved in any theft, prohibition or other pending cases mentioned in the form.
  • Mention whether the vehicle is under hire-purchase, lease or hypothecation and provide the financier's details, if applicable.
  • Sign the application and submit it to request the NOC from the RTO.

    Part 2: To Be Filled by the Financier (If Financed)

This section is applicable if the vehicle is financed through a loan, such as a used car loan. The financier gives consent for the NOC to be issued for the stated purpose. If the financier has any objection, it can refuse to give consent and state the reason for the refusal.

Part 3: To Be Filled by the RTO

If everything is in order, the RTO will issue the NOC. If any additional clarification or information is required, the RTO may communicate the same to the applicant. In case of rejection, the reason for refusing the NOC will be stated in the form and communicated to the applicant.

How to Apply for a Vehicle NOC Online Using Form 28

You can apply for the vehicle NOC online through the VAHAN portal, subject to the online services available for your vehicle and state.

The Steps to Apply for an NOC Online Using Form 28 Include:

  • Log in to the VAHAN portal
  • Select "Online Services" and choose "Application for No Objection Certificate (NOC)"
  • Enter the vehicle registration number and chassis number, and generate an OTP
  • Enter the OTP received on the registered mobile number
  • Select "Issue of NOC" under the service details and enter the required information
  • Enter the required insurance details
  • Upload the required documents through the document upload option
  • Go to "Fee Details", check the applicable fee, and make the payment
  • For further verification, take the filled Form 28 and fee receipt to the concerned RTO, if required. The RTO may verify the documents and complete the NOC process.

What Should You Do After Obtaining the NOC?

Once the NOC is issued, the next step depends on the reason for the transfer. For moving your own vehicle to another state, Form 27 is used along with the NOC. If you are buying a vehicle from another state, Forms 29 and 30 are used for ownership transfer along with the NOC.
