Buying or selling a used car involves more than exchanging the vehicle, keys and payment. The Registration Certificate (RC) must also be transferred from the seller's name to the buyer's name. Until the transfer is completed, the seller may continue to receive traffic fines or legal notices linked to the vehicle. The buyer may also face problems when renewing insurance, making a claim, selling the car or applying for a pre-owned car loan.

The forms and documents required depend on whether the transaction is within the same state, across states or linked to a car loan.

Why is the RC Transfer Important?

The RC (Registration Certificate) records the legal owner of the vehicle. A sale agreement or payment receipt can serve as proof of the transaction, but it does not replace the RC transfer.

Completing the RC Transfer:

  • Records the buyer as the registered owner
  • Reduces the seller's exposure to future fines and notices

Which Forms are Required for a Regular Used-Car Sale?

Forms 29 and 30 are the main RTO forms used in a normal used-car ownership transfer.

1. Form 29: Notice of Transfer of Ownership

Form 29 informs the registering authority that the seller has transferred the vehicle to another person. It usually contains:

  • Vehicle registration number
  • Make and model of the vehicle
  • Chassis and engine numbers
  • Seller's name and address
  • Buyer's name and address
  • Date of sale
  • Signatures of the parties

The seller should keep a signed copy and proof of submission. This can help show when possession of the vehicle was handed over.

2. Form 30: Application for Transfer of Ownership

Form 30 is the formal application to transfer the RC to the buyer's name. It includes details of the vehicle, seller, buyer and financier, if there is any. For a vehicle registered in the same state, the buyer should generally apply within 14 days of the transfer. For a vehicle registered outside the state, the period is generally 45 days. State-specific requirements may apply.

Forms 29 and 30 are normally submitted together. Completing Form 29 alone does not place the RC in the buyer's name.

Which Forms are Needed for an Interstate Sale?

An interstate second-hand car sale may involve additional forms, road tax and re-registration requirements.

1. Form 28: Application for a No Objection Certificate

Form 28 is used to apply for a No Objection Certificate (NOC) from the RTO where the car is currently registered. The NOC indicates that the original registering authority has no objection to the vehicle being transferred or moved to another jurisdiction. The RTO may check whether:

  • Road tax has been paid
  • Traffic penalties are pending
  • The vehicle is involved in a reported offence
  • A loan or hypothecation is recorded
  • Any other legal restriction applies

Form 28 does not transfer ownership. Forms 29 and 30 are still required for the sale.

2. Form 27: Application for a New Registration Mark

Form 27 is used when a vehicle needs a new registration mark in another state. This may apply when the vehicle is permanently moved and re-registration becomes necessary. The buyer may also have to pay road tax in the new state. A refund of the tax paid in the original state may be available, subject to that state's rules and process.

An interstate sale does not automatically mean that Form 27 must be filed immediately in every case. The buyer should check the requirements of the new state and the period for which the vehicle will remain there.

Which Forms Apply When the Car Has a Loan?

A car purchased through a vehicle loan may have the lender's name recorded on the RC as the hypothecation holder. This entry must be handled before or during the ownership transfer.

Form 35: Removing the Seller's Hypothecation

If the seller has repaid the existing car loan, Form 35 is used to remove the lender's hypothecation from the RC. The seller will usually need:

  • Form 35 signed by the registered owner and lender
  • Loan-closure letter
  • NOC from the lender
  • Original RC
  • Valid insurance
  • Applicable fee

The ownership transfer may be delayed if the previous lender's hypothecation remains active. It is advisable to confirm the loan-closure position before paying the full purchase price.

Form 34: Adding the Buyer's New Used Car Loan

If the buyer purchases the used car with a pre-owned car loan, Form 34 is used to record the new lender's hypothecation on the RC. The form is signed by the buyer and the new financier. It may be submitted along with the ownership-transfer application so that the updated RC shows both the buyer's name and the new lender's partial ownership interest.

What Other RTO Forms are Required?

Some used-car transactions involve special circumstances.

1. Form 26: Duplicate RC

Form 26 is used if the original RC has been lost, damaged or destroyed. The seller may need to obtain a duplicate RC before the ownership transfer can proceed.

2. Form 31: Transfer Following the Owner's Death

Form 31 is used to transfer a vehicle after the registered owner's death. Legal heirs may need to provide the death certificate, proof of succession and consent from other heirs.

3. Form 32: Vehicle Purchased at a Public Auction

Form 32 applies when a vehicle is acquired through a public auction conducted by or on behalf of the Central or a State Government.

4. Form 33: Change of Address

Form 33 is used to update the address recorded on the RC. It may be relevant if the registered owner has moved and the RTO records must be updated.

5. Form 29C: Vehicle Delivered to an Authorised Dealer

Form 29C is used to notify the registering authority when a registered vehicle is handed over to an authorised dealer for resale. If the owner later takes the vehicle back from the dealer, Form 29D is used. These forms do not replace the final ownership-transfer process when the vehicle is sold.

What Documents Should Accompany the RTO Forms?

  • Original RC
  • Valid motor insurance certificate
  • Valid Pollution Under Control certificate
  • Buyer's identity proof
  • Buyer's address proof
  • PAN or Form 97 (previously Form 60), where applicable
  • Passport-sized photographs, if requested
  • Chassis and engine pencil print, if required
  • Sale agreement
  • Delivery note
  • Payment receipt
  • Road-tax receipt or tax-clearance certificate
  • Lender's NOC and loan-closure letter, where applicable
  • Applicable transfer fee

The exact checklist can vary between states and RTOs. Some documents may need to be self-attested or submitted in multiple copies.

How Can the Ownership Transfer Be Completed?

  • Check the RC, insurance, PUC and road-tax status
  • Confirm whether any loan or hypothecation is active
  • Clear pending traffic fines or other dues
  • Complete Forms 29 and 30
  • Obtain Form 28 if an interstate NOC is required
  • Complete Forms 34 or 35 if a vehicle loan is involved
  • Submit the application through the VAHAN portal or the relevant RTO
  • Upload or provide the supporting documents
  • Pay the applicable fees and taxes
  • Save the application receipt or acknowledgement
  • Track the application until the RC shows the buyer's name
  • Transfer the motor insurance policy to the buyer

Online services vary by state. The RTO may still request original documents, physical verification or an office visit.

What Mistakes Should Buyers and Sellers Avoid?

  • Leaving sections of the forms incomplete
  • Using details that do not match the RC
  • Missing the buyer's or seller's signature
  • Treating Form 29 as proof that the full transfer is complete
  • Buying a vehicle without checking its loan status
  • Failing to obtain an interstate NOC
  • Handing over the car without a dated delivery note
  • Not keeping copies of the submitted forms
  • Delaying the insurance transfer
  • Failing to track the application after submission

The seller should not rely only on a verbal assurance that the buyer will complete the transfer. The buyer should not assume that possession of the car makes them the registered owner.
